90+ Cellars Ciao Chianti Sweepstakes Rules & Regulations

OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

 The 90+ Cellars Ciao Chianti Wine Trip Sweepstakes (“Sweepstakes”) is open only to legal U.S. residents, 21 years of age or older, with Internet access and a valid e-mail address, as of September 28, 2026.

 By participating, you agree to abide by and be bound by these Official Rules and the decisions of Latitude Beverage Co. (“Sponsor”), which are final and binding in all respects and not subject to appeal.

  1. Sweepstakes Period. Sweepstakes begins September 28, 2026 at or after 7:00:00 a.m. Eastern Time (ET) and ends December 31, 2026 at 11:59:59 p.m. ET.  Sponsor’s computer is the official clock for all purposes of the Sweepstakes.
  2. Sweepstakes Entry.
    1. During the Sweepstakes Period, follow Sponsor's official Instagram account (@90pluscellars) and go to www.ninetypluscellars.com/ciaochianti ("Sweepstakes Website") to complete an official entry form with all required information, including your name, phone number, and email address. Check the box indicating that you have read and agree to these Official Rules, including that you are 21 years of age or older. Then, click the designated button to submit your entry.
    2. All entries must be received by December 31, 2026 at 11:59:59 p.m. ET – the end of the Sweepstakes Period.
  3. Restrictions on Sweepstakes Entry.
    1. Method of Entry; Bonus Entries. During the Sweepstakes Period, an entrant may earn: (i) one (1) entry by following Sponsor's official Instagram account (@90pluscellars) and submitting a completed entry form, including entrant's name, phone number, and email address, via the Sweepstakes Website, as described in Section 2(a) (a "Base Entry"); and (ii) one (1) additional entry (a "Bonus Entry") for each unique individual the entrant tags in the comments of Sponsor's designated Sweepstakes post on Instagram, up to a maximum of ten (10) Bonus Entries per entrant (for a maximum of eleven (11) total entries per entrant). Tagged individuals must be real, distinct Instagram users; self-tags, duplicate accounts, and fictitious profiles will not be counted, and any entries obtained in violation of this paragraph will be void. Sponsor reserves the right, in its sole discretion, to disqualify any entrant who uses multiple email addresses, identities, Instagram accounts, or devices to obtain additional entries, or who otherwise attempts to circumvent this limit.
    2. The use of automated, programmed or like means of entry or third party sweepstakes entry services is strictly prohibited; and, any entries submitted in such manner will be void (even if otherwise eligible) and the corresponding entrant will be disqualified.
    3. Receipt of completed entry may be acknowledged by Sponsor; but, any such acknowledgment does not constitute any representation as to Sweepstakes eligibility, notification of one’s selection as the potential prize winner, nor is it otherwise binding upon Sponsor. Submitted entries become the property of Sponsor and will not be returned.
    4. Proof of transmission of entry does not constitute proof of receipt of same or proof of entry.
    5. In the event of dispute, an entry will be deemed made by the Authorized Account Holder of the email address used to enter the Sweepstakes. Authorized Account Holder means the natural person who is assigned to an email address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
    6. Use of Personal Information. Personal information collected from entrants will be used by Sponsor to administer the Sweepstakes (including winner selection, notification, and prize fulfillment) and otherwise in accordance with Sponsor's Privacy Policy, available at https://www.ninetypluscellars.com/policies/privacy-policy. If an entrant separately opts in by checking the applicable box on the entry form, Sponsor may also use the entrant's email address to send marketing communications from Sponsor. This marketing consent is entirely optional and is not required to enter or participate in the Sweepstakes, and may be withdrawn at any time by following the unsubscribe instructions included in any such communication.
  4. Winner Selection & Notification. 
    1. The prize winner will be selected in a random drawing from among all eligible entries received, to be conducted by Sponsor on or about January 11, 2027.
    2. The potential prize winner will be notified by email and/or phone and must complete, sign and return an Affidavit of Eligibility and a Liability Release within seven (7) days of the date of prize notification. Potential prize winner must augment signed Affidavit/Release with valid government-issued photo identification (e.g., driver’s license or passport). Because the Prize includes international travel to Italy, Winner must also possess a valid, unexpired passport with at least six (6) months of validity remaining beyond the anticipated travel dates. It is Winner’s sole responsibility to timely obtain or renew such passport, and any failure to do so will not extend the validity of the hotel voucher or otherwise obligate Sponsor. In the event of noncompliance with this requirement (including Sponsor’s determination in its sole discretion that tendered identification is unacceptable, inadequate or unreliable); if potential prize winner cannot be contacted for any reason despite Sponsor’s commercially reasonable efforts to do so (for example, email notification to potential prize winner being classified as “SPAM” or “junk,” or not being received or timely received by potential prize winner for any reason); or if potential prize winner is determined to be ineligible or otherwise in violation of these Official Rules, the prize will be forfeited without compensation of any kind and an alternate potential prize winner selected from among all remaining eligible entries received.
  5. Prize/Odds of Winning
    • 1. A trip to Chianti, Italy including:
      • Transportation to the winery, details TBD
      • 2 night’s accommodation in one double room at Castello di Querceto
      • Tasting tour and one dinner at winery
      • $500 AMEX Gift Card to use on your trip
      • Approximate Retail Value: $5,000.00. This figure represents Sponsor’s good faith estimate as to the value of the prize. Should the actual value of the prize differ from such figure, winner will not receive the difference in cash or otherwise.
    • 2. Odds of winning depends on the total number of eligible entries received.
    • 3. ALCOHOL IS NOT PART OF THE PRIZE. 
    • 4. PRIZE DOES NOT INCLUDE ANY ADDITIONAL TRAVEL EXPENSES OR OTHER INCIDENTAL EXPENSES OF ANY KIND INCURRED BY WINNER OR COMPANION IN REDEEMING THE PRIZE.
    • 5. A hotel voucher will be issued to the winner and will be valid for 365 days from date of issuance. This cannot be extended. Advance booking is required by email and subject to availability. Because Castello di Querceto has a limited number of rooms available, winner must submit requested travel dates at least two (2) months in advance of desired travel dates. Hotel may refuse to use Voucher on dates of higher demand and Festive Seasons to be indicated (Carnival, Easter, Christmas, and New Year’s Eve). Blackout dates also apply during the month of August, during which the accommodations will not be available.
    • 6. Sponsor will coordinate with Winner to book airfare and transportation to and from the winery. The wine tasting and dinner at the winery will also be confirmed directly with the winery; Winner must provide Sponsor with requested travel dates at least two (2) months in advance so that Sponsor can first check and confirm availability with the winery. Winner may opt to extend their Chianti trip beyond the 2 night’s accommodation, but all additional expenses and trip planning beyond the Prize detailed above will not be included, and must be handled exclusively by the Winner.
    • 7. Winner’s companion must sign and return a Liability Release prior to prize award. Companion must augment signed Release with valid government-issued photo identification (e.g., driver’s license or passport). Because the Prize includes international travel to Italy, Companion must also possess a valid, unexpired passport with at least six (6) months of validity remaining beyond the anticipated travel dates. It is Companion’s sole responsibility to timely obtain or renew such passport, and any failure to do so will not extend the validity of the hotel voucher or otherwise obligate Sponsor.
    • 8. WINNER AND HIS/HER COMPANION EACH EXPRESSLY ASSUME ANY AND ALL RISKS ATTENDANT TO THE PRIZE.   
    • 9. Winner will be solely responsible for all taxes on the prize and will be issued an IRS 1099 Tax Form reflecting the value of the prize. Winner agrees to provide Sponsor with his/her Social Security Number via IRS W9 Tax Form, as well as to otherwise fully cooperate with Sponsor’s reporting of prize award as per applicable law.
    • 10. No prize substitution except by Sponsor in its sole discretion if advertised prize is unavailable for any reason, and only then for prize of equal or greater value. Prize is not redeemable or exchangeable for cash. Prize is not transferable without the written consent of Sponsor which may be withheld or granted at its sole discretion and without liability of any kind.
    • 11. SPONSOR MAKES NO REPRESENTATION, WARRANTY OR GUARANTEE OF ANY KIND (INCLUDING THE WARRANTY OF MERCHANTABILITY OR FITNESS FOR INTENDED PURPOSE) REGARDING THE PRIZE.
  6. Conditions of Participation.
    1. Sweepstakes is void where prohibited by law. Sponsor’s failure to enforce any provision of these Official Rules in a given instance will not constitute the waiver of such provision.
    2. The following persons are NOT eligible for the Sweepstakes:  (i) employees, officers and directors of Latitude Beverage Co., its parent company, subsidiaries, affiliates and divisions; as well as Latitude Beverage Co.’s agencies, prize suppliers or other entities in any way involved with the advertising, development, distribution or implementation of the Sweepstakes (“Sweepstakes Entities”); (ii) the immediate families of such employees/officers/directors, with “immediate families” being defined as parents, children, siblings, spouse, as well as the spouse of a child/sibling; (iii) members of the same household of such employees/officers/directors, whether related or not; (iv) employees, officers and directors of any entity which holds an alcohol beverage license, including but not limited to alcohol beverage retail licensees. 
  7. Release of Rights.
    1. By participating, entrant indemnifies, releases and agrees to hold harmless Sweepstakes Entities; the directors, officers, agents, representatives, shareholders, employees, successors and assigns of any of the above organizations; as well as Meta or Instagram from any and all liability arising from participating in the Sweepstakes, any Sweepstakes-related activity and/or the acceptance, receipt, possession or use/misuse of the prize (if applicable).
    2. To the fullest extent permitted by law, acceptance of prize constitutes the winner’s agreement to the use of his/her name, address (city, state), likeness, photograph, other indicia of persona and/or statements made by winner regarding the prize, the Sweepstakes or the Sponsor for advertising/publicity/trade purposes by Sponsor and its designees without further compensation or review, approval or notice of any kind. Nothing herein in any way obligates Sponsor to make use of winner for publicity purposes; and, by refraining from doing so, Sponsor will not incur any liability under any legal theory.
  8. Limitations of Liability. 
    1. Sponsor is not responsible for (i) late, lost, incomplete, illegible/garbled, inaccessible, corrupted, damaged or misdirected entries, all of which are void; (ii) any incomplete, incorrect or inaccurate information, whether caused by Sweepstakes Website users (including users of the mobile version of Sweepstakes Website), tampering, hacking or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error; any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of Sweepstakes Website (including mobile version of same), text messages (whether sent by or to Sponsor) or entries; and any problems or technical malfunctions of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, programming or failure of email or text message on account of technical problems or traffic congestion on the Internet or at any mobile web site, web site or any combination thereof; or for injury or damage to entrant’s or to any person’s mobile device or desktop computer (or any information/materials stored therein) related to or resulting from downloading materials from Sweepstakes Website (including mobile version of same) or participating in the Sweepstakes.
    2. Sponsor disclaims any and all liability for any errors in advertising or offering the Sweepstakes. Should there be any inconsistency between these Official Rules and Sweepstakes advertising material, these Official Rules will prevail, govern and control in all respects.
    3. Sponsor’s failure to enforce any provision of these Official Rules in a given circumstance shall NOT function as a waiver of such provision.
    4. Force Majeure. If, for any reason, the Sweepstakes (or any part thereof) is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, riot, strike, civil commotion, governmental regulation or any other causes beyond the control of Sponsor which, in its sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select the prize winner from among all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor or otherwise in a manner which is fair, equitable and in accordance with these Official Rules, as determined by Sponsor in its sole discretion. Notice of such action by Sponsor will be posted on the Sweepstakes Website.
    5. CAUTION: ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES OR TO DEFRAUD LATITUDE BEVERAGE CO. IN CONJUNCTION THEREWITH CONSTITUTES TAMPERING IN VIOLATION OF THESE OFFICIAL RULES AS WELL AS A VIOLATION OF CIVIL AND/OR CRIMINAL LAW. IN SUCH CASE, LATITUDE BEVERAGE CO.  MAY SEEK ANY AND ALL AVAILABLE LEGAL REMEDIES AGAINST PERSONS DETERMINED TO BE ENGAGED IN SUCH CONDUCT AS WELL AS DISQUALIFYING THEM FROM THE SWEEPSTAKES (IF APPLICABLE.)   
    6. This promotion is in no way sponsored, endorsed or administered by, or associated with Meta or Instagram.
  9. DISPUTE RESOLUTION/GOVERNING LAW.
    • To the fullest extent permitted by law, by participating in the Sweepstakes, you agree:
      • these Official Rules and this Sweepstakes shall be governed by the substantive laws of Massachusetts (i.e., without regard to the choice of law/conflict of law principles of Massachusetts); 
      • that any action at law or in equity arising out of or relating to these Official
      • Rules or this Sweepstakes shall be filed exclusively in the U.S. District Court for the District of Massachusetts (in Boston) or Massachusetts State Court in Suffolk County (in Boston)
      • to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action, waiving any right of change or venue, forum non conveniens or the like;
      • that any such action shall be resolved individually, NOT as part of a class action;
      • that any claims/judgments/awards shall be limited to actual out-of-pocket costs incurred (if any), with all other forms of damages, remedies and relief being expressly waived, and under no circumstances will you be awarded attorneys’ fees.
  10. Winner’s List. To obtain the name of the winner (first name, last initial; city/state), send an email request to support@ninetypluscellars.com. Requests must be received by March 31, 2027. The winner's list will be available upon request on or after February 14, 2027.
